PURPOSE AND SCOPE:

The Manager, By-law Enforcement, is responsible for the overall operation, administration, and function of By-law Enforcement and Licensing. This position will ensure effective, efficient, and cost-effective delivery of all services provided by By-law Enforcement, including parking, citation management, property standards, licensing, and other municipal by-laws. This position will manage as well as coordinate the direction and guidance of work for the by-law, parking citation and licensing staff.

This position will lead the enforcement of various municipal by-laws, including those related to licensing, citation management, and property standards by-laws, ensuring the prompt and courteous response to complaints regarding infractions, issuing notices of violation, conducting investigations and reports, and preparing necessary information for court prosecuting and/or assisting the prosecution on behalf of the municipality during court proceedings.

KEY DUTIES AND RESPONSIBILITIES:

  • Actively participate in staff recruitment, orientation, development, training, performance management, workplace safety, and coaching in conjunction with Human Resources.
  • Adhere to City HR policies and employment and Health and safety-related legislation, keeping abreast of emerging legislation relevant to the city's business.
  • Manage the day-to-day scheduling, organization, coordination, and monitoring associated with staff work.
  • Provide regular and constructive feedback to staff on performance; recognize achievements and offer individualized support.
  • Investigate, enforce, analyze, interpret and seek compliance related to licensing and by-law enforcement, including public education and clarification of by-laws.
  • Oversee the implementation of new by-law enforcement or licensing programs that the city may establish.
  • Provide advice and recommendations to Council on by-law and enforcement matters.
  • Enforce the city's by-laws, including (but not limited to) parking, property standards, taxicabs, land use, noise, business, lottery, STA and signage.
  • Respond to complaints from members of the public regarding by-law compliance and parking enforcement.
  • Oversee the administration of the Animal Control and Humane Society Hastings Prince Edward contracts and associated by-laws.
  • Develop policies and by-laws to promote the safety and well-being of the community and make related recommendations to the Council.
  • Develop, review and implement, as necessary, changes in inspection and enforcement policies, procedures, protocols and administrative processes based on court rulings and legislative changes.
  • Review requests and make recommendations to the Council regarding by-law exemption requests.

EDUCATION/SPECIALIZED TRAINING/SKILLS:
Minimum Qualifications:

  • Two (2) year college diploma in Law Enforcement or equivalent post-secondary program required.
  • Willingness to obtain full membership/certification both the Ontario Association of Property Standards Officers and the Municipal Law Enforcement Officers Association within three years.
  • Valid class "G" driver's license with clean driver's abstract.
  • A clear Ontario Police Records Check

Preferred Qualifications:

  • Member of the Prosecutors Association and successful completion of Prosecutors Training.
  • Building and property inspection experience related to property standards.
  • Provincial qualification as set out in the Ontario Building Code for General Legal.
  • Demonstrated experience participating in legal proceedings and related functions.
  • Excellent interpersonal, investigative, report-writing, problem-solving and organizational skills and verbal and written communication skills, including the ability to communicate with clients and members of the public tactfully and convincingly.
  • Demonstrated experience in political insight, customer service delivery, supervisory experience and by-law enforcement.
  • Thorough working knowledge of the Provincial Offences Act, Highway Traffic Act, Municipal Act, Ontario Building Code Act, Planning Act, Municipal Freedom of Information and Protection of Privacy Act and Regulations, and other pertinent legislation related to enforcing regulatory by-laws.
  • Familiarity with the Administrative Monetary Penalty System.

WORK EXPERIENCE:

Essential Qualifications:

  • Minimum of seven (7) years related experience in municipal law enforcement enforcing and interpreting by-laws (e.g., traffic, site alteration, zoning, property standards, etc.)
  • Demonstrated business writing skills, including but not limited to writing Council Reports, drafting by-law documentation, and preparing meeting notes.
  • Demonstrated computer skills including but not limited to Microsoft 365 programs including Outlook, Word, Excel, and PowerPoint, and other document writing, reporting and archival programs.

Asset Qualifications:

  • Experience managing and directing staff in a unionized environment is an asset.
  • Minimum of three (3) years in a leadership role, supervising staff; in a municipal environment preferred.
